ผมเลือกข้อสัญญาที่สำคัญๆมาเท่านั้นนะครับ

11.The Lessee shall reside in the Premises throughout the Rental Term. In case the Lessee moves out after completing the Rental Term of this Agreement, the Lessor shall agree to refund to the Lessee all the 2 mounths of Security Deposit and after being deducted the damages or the pending eletricity, water and telephone bills if ant. The Security Deposit will be forfeited in case of early termination by the Lessee prior to the end of the Rental Term.

14.If the Lessee is in breach of any provision of this Agreement, the Lessor shall be entitled to terminate this Agreement. Such termination by the Lessor shall not prejudice any other rights of claims of the Lessor under the laws. Upon expiration or termination of this Agreement, the Lessee shall return the Premises and furniture in good and same condition of the date of this Agreement.

ตอนผมเช่าคอนโดผมจ่ายค่าประกัน2เดือนพร้อมค่าเช่าล่วงหน้าเดือนสุดท้าย1เดือน แต่ผมย้ายออกก่อนเวลา ผมถูกยึดค่าประกัน(Security Deposit)ตรงนั้นผมไม่ข้องใจ แต่ค่าเช่าล่วงหน้า(Advance) ในสัญญาไม่ได้ระบุไว้ว่าจะยึด แต่เจ้าของอ้างสัญญาข้อ14ว่าผมไม่มีสิทธิที่จะใช้สิทธิค่าเช่าล่วงหน้าได้ เขาจึงเก็บค่าเช่าเดือนสุดท้ายเพิ่มไปอีกก่อนผมย้ายออก(จ่ายไปแล้วมีใบเสร็จให้)

ผมขอเรียนถามคุณมีชัยว่าถ้าผมมีสิทธิขอเงินค่าเช่าล่วงหน้าเดือนสุดท้ายคืนได้ไหมครับ
